However, for economic reasons on the one hand, and in order to ensure the respect of regulatory provisions (relating to morality, public order and security as well as to the protection of plants, health and life of people and animals), these legislative and regulatory texts have provided for derogatory regimes to<strong> the principle of freedom.<\/strong><\/p><p>By way of derogation from the provisions of <a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/D93.313-conditions-dimportation-et-dexportation-version-consolidee-14-fev.-2018.pdf\">Decree n\u00b093-313 of 11 March 1993<\/a>, the profession of exporter of coffee, cocoa (<a href=\"http:\/\/www.conseilcafecacao.ci\/\">Conseil Caf\u00e9 \u2013 Cacao<\/a>), pineapple, banana, timber and wood products as well as cashew nuts and cotton (<a href=\"http:\/\/www.conseilcotonanacarde.ci\/\">Conseil Coton \u2013 Anacarde<\/a>) is subject to technical approval. This approval from the Ministry concerned is, <strong>in general, valid for one (1) year or per season.<\/strong><\/p><p>In accordance with C\u00f4te d\u2019Ivoire\u2019s liberal economic option, the export of any goods or merchandise is free, with the exception of products subject to a <strong>Preliminary Authorisation<\/strong> \u2013 see list in Annex D of <a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/Annexe-A-D93.313-conditions-dimportation-et-dexportation-en-RCI.pdf\">Decree No. 93-313 of 11 March 1993<\/a> \u2013 and under the <strong>Prohibition Regime<\/strong> (raw ivory and certain types of wood) \u2013 see list in <a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/Annexe-A-D93.313-conditions-dimportation-et-dexportation-en-RCI.pdf\">Annex E of Decree No. 93-313 of 11 March 1993<\/a>.<\/p><p>In addition to the approvals required for certain professions (see above), it is necessary for a legal or natural person wishing to export to have an Importer\/Exporter Code or an Occasional Importer\/Exporter Code. These products are as follows<\/p><ul><li>Raw Ivory<\/li><li>Wood in logs and certain types of raw wood: Aboudikrou, Mahogany, Avodire, Bosse, Sipo, Dibetou, Ipoko, Malcore, Tiama, Kondroui, Bois de vene.<\/li><li>Ferrous products: Scrap iron, Cast iron, Ferrous by-products<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div id=\"e-n-tab-content-1502839172\" role=\"tabpanel\" aria-labelledby=\"e-n-tab-title-1502839172\" data-tab-index=\"2\" style=\"--n-tabs-title-order: 2;\" class=\" elementor-element elementor-element-6cbbf88 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"6cbbf88\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-464f305 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"464f305\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Notwithstanding the provisions of <a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/D93.313-conditions-dimportation-et-dexportation-version-consolidee-14-fev.-2018.pdf\">Decree n\u00b0 93-313 of 11 March 1993,<\/a> the exercise of the <strong>Profession of Exporter<\/strong> of Coffee, Cocoa, Pineapple, Cotton, Cashew nuts, Bananas, Mangoes \u2013 Cf. <a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/A2015.346-Agriculture-enregistrement-exportateurs-de-mangue-1-2.jpg\">Order n\u00b02015. 346 of 06 July 2015<\/a> \u2013 of Wood in Logs and Wood Products, Rubberood and Oil Palm Products are subject to obtaining an Approval issued by the competent Technical Ministry (Cf. specific pages of the site for these products).<\/p><p>This <strong>Approval<\/strong> is, in general, <strong>valid for one (1) year, or per agricultural season.<\/strong><\/p><p>Specific articles are devoted to the <strong>Exportation of Coffee and Cocoa<\/strong> [Exportation \u2013 Agriculture \u2013 Coffee \u2013 Cocoa] as well as <strong>Cotton and Cashew nuts<\/strong> [Exportation \u2013 Agriculture \u2013 Cotton \u2013 Cashew nuts].<\/p><p><strong>In addition, this derogation has been extended to other Agricultural Products through the progressive establishment of comparable Sectors, notably for Pineapple, Banana, Rubber wood, Timber and certain Wood Products.<\/strong><\/p><p>Prior steps and documents to be produced to Customs before each shipment:<\/p><ul><li>The Export Certificate if the value of the exported products is greater than or equal to ten (10) million F CFA (GUCE procedure).<\/li><li>The Exchange Commitment if the value of the exported products is greater than or equal to ten (10) million F CFA (GUCE procedure).<\/li><li>Preliminary Export Authorisation (for products listed in Annex E of Decree n\u00b093-313 of 11 March 1993).<\/li><\/ul><p><strong>Exports of metallic ores, gems and precious metals are subject to the Prior Authorisation Regime <\/strong>(see <a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/Annexe-A-D93.313-conditions-dimportation-et-dexportation-en-RCI.pdf\">Annexes E and F of Decree n\u00b0 93-313<\/a><strong> of 11 March 1993) <\/strong>for which the exporter must obtain<\/p><ul><li>Authorisation from the <a href=\"http:\/\/www.industrie.gouv.ci\/\">Ministry of Industry and Mines.<\/a><\/li><li>An authorisation from the <a href=\"http:\/\/www.finances.gouv.ci\/\">Ministry of Economy and Finance.<\/a><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div id=\"e-n-tab-content-1502839173\" role=\"tabpanel\" aria-labelledby=\"e-n-tab-title-1502839173\" data-tab-index=\"3\" style=\"--n-tabs-title-order: 3;\" class=\" elementor-element elementor-element-90d2d8b e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"90d2d8b\" class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The administrative procedures, before any export of goods from C\u00f4te d\u2019Ivoire, are defined in the Inter-ministerial <a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/A2014.127-MCAPPME-MPMB-importation-des-marchandises.pdf\">Order n\u00b0127\/MCAPPME\/MPMB of 21 March 2014.<\/a><\/p><p>The necessary documents are as follows:<\/p><ul><li>A <strong>Taxpayer Account Number<\/strong> (or Tax Filer Number), obtained for companies with an <strong>Attestation de D\u00e9claration Fiscale d\u2019Existence (DFE)<\/strong> established with the services of the Direction G\u00e9n\u00e9rale des Imp\u00f4ts.<\/li><li>An Importer\/Exporter Code or Occasional Importer\/Exporter Code (see Procedure below).<\/li><li>An <strong>Exporter Approval<\/strong> (for any product subject to the Approval Scheme, i.e. Coffee, Cocoa, Pineapple, Banana, Timber and Wood Products Exporters) \u2013 see BECOMING AN EXPORTER IN COTE D\u2019IVOIRE The rules applicable to all exports in C\u00f4te d\u2019Ivoire are mainly contained in Law n\u00b091.999 on competition Decree n\u00b093.313 of 11 March 1993 on the conditions of entry into C\u00f4te d\u2019Ivoire of foreign goods and on the conditions of export and re-export of goods to foreign countries. Inter-ministerial Order n\u00b0127\/MCAPPME\/MPMB of 21 March 2014 LEGAL REGIMES FOR EXPORTS REGULATED PROFESSIONS ADMINISTRATIVE PROCEDURES There are three (3) export regimes: The freedom regime. The regime of prior authorization. The regime of prohibitions\/ prohibitions. 1-Freedom regime In accordance with the liberal economic option of C\u00f4te d\u2019Ivoire, the export of any goods or merchandise is free, with the exception of those listed in Annexes E and F of Decree n\u00b093-313 of 11 March 1993. 2-Preliminary authorisation regime Precious metals and minerals listed in Annex E of Decree No. 93-313 of 11 March 1993 are subject to the Prior Authorisation for Export regime. The export of these products requires from the exporter: Authorization from the Ministry of Mines and Energy Authorization from the Ministry of Economy and Finance The Pre-Export Authorization is valid for one order only. 3-Prohibition regime These are prohibitions aimed at ensuring the protection of fauna and flora, but also concern Ivory and certain types of wood as indicated in Annex F of Decree n\u00b093-313 of 11 March 1993. These products are as follows Raw Ivory Wood in logs and certain types of raw wood: Aboudikrou, Mahogany, Avodire, Bosse, Sipo, Dibetou, Ipoko, Malcore, Tiama, Kondroui, Bois de vene. Ferrous products: Scrap iron, Cast iron, Ferrous by-products Notwithstanding the provisions of Decree n\u00b0 93-313 of 11 March 1993, the exercise of the Profession of Exporter of Coffee, Cocoa, Pineapple, Cotton, Cashew nuts, Bananas, Mangoes \u2013 Cf. Order n\u00b02015. 346 of 06 July 2015 \u2013 of Wood in Logs and Wood Products, Rubberood and Oil Palm Products are subject to obtaining an Approval issued by the competent Technical Ministry (Cf. specific pages of the site for these products). This Approval is, in general, valid for one (1) year, or per agricultural season. Specific articles are devoted to the Exportation of Coffee and Cocoa [Exportation \u2013 Agriculture \u2013 Coffee \u2013 Cocoa] as well as Cotton and Cashew nuts [Exportation \u2013 Agriculture \u2013 Cotton \u2013 Cashew nuts]. In addition, this derogation has been extended to other Agricultural Products through the progressive establishment of comparable Sectors, notably for Pineapple, Banana, Rubber wood, Timber and certain Wood Products. Prior steps and documents to be produced to Customs before each shipment: The Export Certificate if the value of the exported products is greater than or equal to ten (10) million F CFA (GUCE procedure). The Exchange Commitment if the value of the exported products is greater than or equal to ten (10) million F CFA (GUCE procedure). Preliminary Export Authorisation (for products listed in Annex E of Decree n\u00b093-313 of 11 March 1993). Exports of metallic ores, gems and precious metals are subject to the Prior Authorisation Regime (see Annexes E and F of Decree n\u00b0 93-313 of 11 March 1993) for which the exporter must obtain Authorisation from the Ministry of Industry and Mines. An authorisation from the Ministry of Economy and Finance. The administrative procedures, before any export of goods from C\u00f4te d\u2019Ivoire, are defined in the Inter-ministerial Order n\u00b0127\/MCAPPME\/MPMB of 21 March 2014. The necessary documents are as follows: A Taxpayer Account Number (or Tax Filer Number), obtained for companies with an Attestation de D\u00e9claration Fiscale d\u2019Existence (DFE) established with the services of the Direction G\u00e9n\u00e9rale des Imp\u00f4ts. An Importer\/Exporter Code or Occasional Importer\/Exporter Code (see Procedure below). An Exporter Approval (for any product subject to the Approval Scheme, i.e. Coffee, Cocoa, Pineapple, Banana, Timber and Wood Products Exporters) \u2013 see Product sheets.
