This Convention was designed to regulate, control and <strong>reduce<\/strong> <strong>the movement of hazardous wastes between countries (but especially from developed to developing countries)<\/strong>. The Convention also aims to minimize the quantity and toxicity of wastes generated, and to assist developing countries to reasonably manage the wastes, harmful or not, that they generate. In order to comply with the Convention, C\u00f4te d\u2019Ivoire has issued the following decrees:<\/p><ul><li><a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/A2012.11ENVIR-creation-comite-national-des-dossiers-mouvements-transfrontieres-dechets.pdf\"><em><u>Order n\u00b011 MINSEDD\/DGE\/PFCB of March 15, 2012<\/u><\/em><\/a> on the creation, attribution, organization and functioning of the National Committee for the Analysis of Transboundary Waste Movement Files.<\/li><li><a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/A2012.12-Environnement-transfert-transfrontieres-des-dechets.pdf\"><em><u>Order n\u00b012 MINEDD\/DGE\/PFCB of 15 March 2012<\/u><\/em><\/a> on the procedure for the Authorization of Transboundary Movements of Waste.<\/li><\/ul><p><a href=\"http:\/\/www.environnement.gouv.ci\/fichier\/1432667898organigraminesudd.pdf\"><strong><u>The General Directorate of Environment<\/u><\/strong><\/a> of<a href=\"http:\/\/www.environnement.gouv.ci\/\"> <strong><u>the Ministry of Environment and Sustainable Development<\/u><\/strong><\/a> is <strong>the competent authority for the Basel Convention in C\u00f4te d\u2019Ivoire.<\/strong><\/p><p>Before any export operation, the economic operator must fill in <a href=\"http:\/\/www.basel.int\/Portals\/4\/Basel%20Convention\/docs\/techmatters\/forms-notif-mov\/vCOP8_f.pdf\"><strong>a notification and transboundary movement of waste document<\/strong><\/a> and constitute a file that will be examined by the <strong>National Committee for the Analysis of Transboundary Movement of Waste Files<\/strong> in order to obtain an <strong>Approval<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-a5f8fd8 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"a5f8fd8\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-1f4072e e-n-tabs-mobile exad-glass-effect-no elementor-widget elementor-widget-n-tabs\" data-id=\"1f4072e\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;horizontal_scroll&quot;:&quot;disable&quot;}\" data-widget_type=\"nested-tabs.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"e-n-tabs\" data-widget-number=\"32769838\" aria-label=\"Tabs. It can be reached at the following emails: envsec@gmail.com or gnamessou2005@yahoo.fr<\/p><p><strong>This documentation <\/strong>must be<strong> filled out<\/strong> and must <strong>accompany the application for authorization<\/strong>.<\/p><p><strong>The list of documents to be provided for a request for authorization of a transfer of hazardous waste:<\/strong><\/p><ul><li>A letter of request for authorization addressed to the Minister of the Environment and Sustainable Development;<\/li><li>Information about the Company, including:<ul><li>The Company\u2019s Articles of Association.<\/li><li>A copy of the Trade Register with the nature of the activity.<\/li><li>The CNPS certificate (National Social Security Fund).<\/li><li>The Tax Certificate.<\/li><li>Photocopy and original of the National Identity Card or Identity Certificate or Passport of the person(s) in charge of the Company.<\/li><li>The passport photo of the person(s) in charge of the company.<\/li><li>Criminal record of the Company\u2019s manager(s) dated within three (3) months.<\/li><li>The geographical location of the Company.<\/li><li>The Insurance Certificate.<\/li><\/ul><\/li><li><a href=\"http:\/\/www.basel.int\/Portals\/4\/Basel%20Convention\/docs\/techmatters\/forms-notif-mov\/vCOP8_f.pdf\"><u>Notification and Cross-Border Waste Movement Documents.<\/u><\/a><\/li><li>Information on the waste to be imported, including:<\/li><li>Preliminary identification sheet of the waste.<\/li><li>Safety measures during transport.<\/li><li>Description of the packaging.<\/li><li>Transport itinerary.<\/li><li>The Financial Guarantee to the benefit of the Ministry in charge of the Environment.<\/li><li>The Contract binding the applicant Company to the recipient of the waste (in case of export) or to the Company of origin of the waste (in case of import).<\/li><\/ul><p><strong>The file is to be deposited in the offices of the General Directorate of the Environment or in the Mail Service of the Ministry in charge of the Environment.<\/strong><\/p>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"d17c79c\" data-element_type=\"widget\" data-widget_type=\"heading.default\"><h5>OBTAINING AUTHORIZATION FOR THE TRANSFER OF HAZARDOUS WASTE<\/h5><p>The file is submitted to a National Committee for the Analysis of the Files of cross-border Movements of Wastes which meets about 4 times a year \u2013<a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/A2012.11ENVIR-creation-comite-national-des-dossiers-mouvements-transfrontieres-dechets.pdf\"> <u>Cf. Order n\u00b00011 MINEDD\/DGE\/PFCB of March 15th, 2012<\/u><\/a>.The National Committee is composed of the following structures:<\/p><ul><li>Ministry of Environment and Sustainable Development (DDISC, CIAPOL, Directorate of Legal Affairs and Litigation, Basel Convention Focal Point).<\/li><li>Ministry of Mines and Energy.<\/li><li>Directorate General of Maritime Affairs.<\/li><li>Autonomous Port of Abidjan.<\/li><li>Autonomous Port of San Pedro.<\/li><li>General Directorate of Customs.<\/li><\/ul><p>The Economic Operator is informed by the office of the General Directorate of the Environment of the decision of the National Committee.<\/p><p>The Operator must then provide this <strong>Approval<\/strong> to the exporter of the country of origin so that it can obtain an <strong>Authorization of Exportation <\/strong>of its country towards the Ivory Coast.<\/p><p><strong>The Authorization of Transfer of Hazardous Wastes<\/strong> is a document necessary to establish the Form of Declaration to the Import (FDI) of the <u>Single <a href=\"https:\/\/guce.gouv.ci\/?namespaceController=home&amp;lang=en\">Window for Foreign Trade in Ivory Coast<\/a><\/u>, GUCE.<\/p><p><strong>Cost of obtaining the Hazardous Waste Transfer Authorization: Free of charge<\/strong> (pending the implementation of the bylaws and the creation of the agency).<\/p><p><strong>Deadline for obtaining the Hazardous Waste Transfer Authorization<\/strong>: The National Committee meets <strong>4 times a year<\/strong> to examine and approve the Hazardous Waste Transfer Authorizations.<\/p><p><strong>Note<\/strong>: Further information can be obtained from the Basel Convention Focal Point at the following email addresses<\/p><ul><li>envsec@gmail.com<\/li><li>gnamessou2005@yahoo.fr<\/li><\/ul><\/div>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div id=\"e-n-tab-content-327698383\" role=\"tabpanel\" aria-labelledby=\"e-n-tab-title-327698383\" data-tab-index=\"3\" style=\"--n-tabs-title-order: 3;\" class=\" elementor-element elementor-element-18f7858 e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"18f7858\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-929d238 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-exad-exclusive-tabs\" data-id=\"929d238\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"exad-exclusive-tabs.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"exad-tabs-929d238 exad-advance-tab exad-tab-vertical \" data-tabs>\r\n\t\t\t\r\n\t\t\t<ul class=\"exad-advance-tab-nav\">\r\n\t\t\t\t\t\t\t\t\t<li class=\"active \" data-tab>\r\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"exad-tab-title\">\r\n\t\t\t\t\t\t1\t\t\t\t\t\t<\/span>\r\n\t\t\t\t\t<\/li>\r\n\t\t\t\t\t\t\t\t\t<li class=\" \" data-tab>\r\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"exad-tab-title\">\r\n\t\t\t\t\t\t2\t\t\t\t\t\t<\/span>\r\n\t\t\t\t\t<\/li>\r\n\t\t\t\t\t\t\t\t\t<li class=\" \" data-tab>\r\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"exad-tab-title\">\r\n\t\t\t\t\t\t3\t\t\t\t\t\t<\/span>\r\n\t\t\t\t\t<\/li>\r\n\t\t\t\t\t\t\t\t\t<li class=\" \" data-tab>\r\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"exad-tab-title\">\r\n\t\t\t\t\t\t4\t\t\t\t\t\t<\/span>\r\n\t\t\t\t\t<\/li>\r\n\t\t\t\t\t\t\t<\/ul>\r\n\t\t\t\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no active exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<h5>IMPORT DECLARATION FORM (FDI)<\/h5><p>The Import Declaration Form (FDI) <strong>is compulsory if the value of the goods exceeds five hundred thousand (500,000) F CFA.<\/strong>\u00a0 The IDF is established online via the transactional site of <u>the\u00a0<\/u><u><a href=\"https:\/\/guce.gouv.ci\/?namespaceController=home&amp;lang=en\">Window for Foreign Trade in Ivory Coast<\/a><\/u>, GUCE. Access to the site requires <strong>prior registration as an importer, exporter or forwarder<\/strong> (<u><a href=\"https:\/\/guce.gouv.ci\/register\/procedure\">https:\/\/guce.gouv.ci\/register\/procedure<\/a>).<\/u> The documents and information to be provided are as follows:<\/p><ul><li>Importer Code (or Occasional Importer Code).<\/li><li>Pro forma or final invoice.<\/li><li>Mode of transport.<\/li><li>Name of the importer\u2019s bank (in C\u00f4te d\u2019Ivoire) (for direct debit and exchange authorisation).<\/li><li>HS Codes of the products to be imported.<\/li><li>Copy of the Authorisation for the Transfer of Hazardous Waste signed by the National Committee.<\/li><\/ul>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"d17c79c\" data-element_type=\"widget\" data-widget_type=\"heading.default\"><h5>CARGO TRACKING FORM (CTF)<\/h5><p><strong>Import by sea<\/strong><\/p><p>For all imports by sea, the exporter, the foreign forwarder and the importer must register the <a href=\"http:\/\/www.oic.ci\/\"><strong>Cargo Tracking Form (CTF)<\/strong><\/a> via the website of <u>the Ivorian Shippers\u2019 Office<\/u> (OIC).<\/p><p>At embarkation, registration of the CTF (see General Import Procedures tab of the website). The documents required are the following:<\/p><ul><li>Final Invoice.<\/li><li>Bill of Lading (B\/L),<\/li><li>Packing List.<\/li><li>Customs Export Declaration of the country of shipment.<\/li><li>Certificate of local insurance in Ivory Coast.<\/li><li>The Import Declaration Form (IDF) or its number.<\/li><\/ul><p>In addition, for imports from countries outside the European Union, the following are required:<\/p><ul><li>The Freight Invoice.<\/li><li>The Certificate of Origin.<\/li><\/ul><\/div>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"d17c79c\" data-element_type=\"widget\" data-widget_type=\"heading.default\"><h5>CERTIFICATE OF VALUE<\/h5><p><strong>As soon as the goods are shipped and all the transport documents for the goods are<\/strong> available (Final Commercial Invoice, Bill of Lading or Air Waybill, Packing List, Freight Invoice, copy of the IDF and all other available certificates), the freight forwarder must initiate a request for a <strong>Certificate of Value<\/strong>.<\/p><p>All goods with an FOB value greater than or equal to one (1) million F CFA must obtain a <strong>Final Value Classification Report (FVCR)<\/strong> from the <strong>Directorate of Risk Analysis, Intelligence and Value (DARRV)<\/strong> of the Customs via <a href=\"https:\/\/guce.gouv.ci\/?namespaceController=home&amp;lang=en\">the electronic platform of <em><u>the GUCE<\/u><\/em><\/a> \u2013 <u>Cf.<a href=\"https:\/\/www.gucecotedivoire.ci\/pwic\/wp-content\/uploads\/transfert-de-competences-webb-fontaine-douanes-ivoiriennes.png\">Customs Circular n\u00b02007 of 29 March 2019.<\/a><\/u><\/p><p>The authorised forwarder downloads and fills in the<strong> Notice of Deposit (ND). <\/strong><\/p><p>He attaches the documents accompanying the goods (see list above) to the deposit notice and uploads the entire file online on the GUCE platform.<\/p><p><strong>The Customs Directorate of Risk Analysis, Intelligence and Value (DARRV)<\/strong> checks the shipping documents and delivers <strong>the Final Classification and Value Report<\/strong> by e-mail to the consignee or freight forwarder within <strong>5 working days<\/strong> of the submission of the documents.<\/p><p>The freight forwarder completes <strong>Form D41<\/strong> [Sampling Permit: this is an authorisation given by the importer or freight forwarder to Customs to take a sample of the goods for the purpose of quality control or to visually assess the apparent condition of the goods] and physically deposits it with the transport documents (see List above) at the Risk Analysis, Intelligence and Value Division (DARRV) of Customs for verification.<\/p><p>After examining the file, the DARRV issues the <strong>Attestation of Verification (AV).<\/strong><\/p><p><strong>Goods with an FOB value of less than one (1) million CFA francs and certain other products<\/strong> (see the list of goods not subject to FCVR on the website <u>www.douane.ci<\/u>) are <strong>exempt from the FCVR procedure<\/strong>. (See General Import Procedures on the website).<\/p><\/div>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"d17c79c\" data-element_type=\"widget\" data-widget_type=\"heading.default\"><p>\u00a0<\/p><h5>CUSTOMS DECLARATION ON ARRIVAL<\/h5><p>The Customs declaration is made by a forwarder appointed by the importer and approved by <u>Customs<\/u>. The forwarder submits the declaration in the Customs computer system \u2013 SYDAM (Sydonia World). This Convention was designed to regulate, control and reduce the movement of hazardous wastes between countries (but especially from developed to developing countries). The Convention also aims to minimize the quantity and toxicity of wastes generated, and to assist developing countries to reasonably manage the wastes, harmful or not, that they generate. In order to comply with the Convention, C\u00f4te d\u2019Ivoire has issued the following decrees: Order n\u00b011 MINSEDD\/DGE\/PFCB of March 15, 2012 on the creation, attribution, organization and functioning of the National Committee for the Analysis of Transboundary Waste Movement Files. Order n\u00b012 MINEDD\/DGE\/PFCB of 15 March 2012 on the procedure for the Authorization of Transboundary Movements of Waste. The General Directorate of Environment of the Ministry of Environment and Sustainable Development is the competent authority for the Basel Convention in C\u00f4te d\u2019Ivoire. Before any export operation, the economic operator must fill in a notification and transboundary movement of waste document and constitute a file that will be examined by the National Committee for the Analysis of Transboundary Movement of Waste Files in order to obtain an Approval. AUTHORIZATION PROCEDURE REQUIEREDDOCUMENTS INSTITUTIONSINVOLVED IMPORT AUTHORIZATION Before any transboundary movement operation, any legal entity wishing to import, export or transit hazardous wastes must first fill in a Notification and Transboundary Movement of Wastes document and then compile a file before applying for a Waste Transfer Authorization addressed to the Minister of Environment and Sustainable Development who will forward it to the National Committee for the Analysis of Transboundary Movements of Wastes Files for approval. There is no charge for the examination of the file in C\u00f4te d\u2019Ivoire. Etape 1 Etape 2 Documentation to be completed The notification and transboundary movement of wastes documents can also be downloaded from the Basel Convention website or are physically available in the offices of the Direction des D\u00e9chets Industriels et Substances Chimiques (DDISC) at Riviera 3, not far from the Lyc\u00e9e Fran\u00e7ais. The DDISC also houses the Basel Convention focal point. The list of documents to be provided for a request for authorization of a transfer of hazardous waste: A letter of request for authorization addressed to the Minister of the Environment and Sustainable Development; Information about the Company, including: The Company\u2019s Articles of Association. A copy of the Trade Register with the nature of the activity. The CNPS certificate (National Social Security Fund). The Tax Certificate. Photocopy and original of the National Identity Card or Identity Certificate or Passport of the person(s) in charge of the Company. The passport photo of the person(s) in charge of the company. Criminal record of the Company\u2019s manager(s) dated within three (3) months. The geographical location of the Company. The Insurance Certificate. Notification and Cross-Border Waste Movement Documents. Information on the waste to be imported, including: Preliminary identification sheet of the waste. Safety measures during transport. Description of the packaging. Transport itinerary. The Financial Guarantee to the benefit of the Ministry in charge of the Environment. The Contract binding the applicant Company to the recipient of the waste (in case of export) or to the Company of origin of the waste (in case of import). The file is to be deposited in the offices of the General Directorate of the Environment or in the Mail Service of the Ministry in charge of the Environment. OBTAINING AUTHORIZATION FOR THE TRANSFER OF HAZARDOUS WASTE The file is submitted to a National Committee for the Analysis of the Files of cross-border Movements of Wastes which meets about 4 times a year \u2013 Cf. Order n\u00b00011 MINEDD\/DGE\/PFCB of March 15th, 2012.The National Committee is composed of the following structures: Ministry of Environment and Sustainable Development (DDISC, CIAPOL, Directorate of Legal Affairs and Litigation, Basel Convention Focal Point). Ministry of Mines and Energy. Directorate General of Maritime Affairs. Autonomous Port of Abidjan. Autonomous Port of San Pedro. General Directorate of Customs. The Economic Operator is informed by the office of the General Directorate of the Environment of the decision of the National Committee. The Operator must then provide this Approval to the exporter of the country of origin so that it can obtain an Authorization of Exportation of its country towards the Ivory Coast. The Authorization of Transfer of Hazardous Wastes is a document necessary to establish the Form of Declaration to the Import (FDI) of the Single Window for Foreign Trade in Ivory Coast, GUCE. Cost of obtaining the Hazardous Waste Transfer Authorization: Free of charge (pending the implementation of the bylaws and the creation of the agency). Deadline for obtaining the Hazardous Waste Transfer Authorization: The National Committee meets 4 times a year to examine and approve the Hazardous Waste Transfer Authorizations.
