href=\"http:\/\/www.basel.int\/\"> Basel Conventione<\/a><\/em><\/strong><strong>\u00a0on the Control of Transboundary Movements of Hazardous Wastes and their Disposal is an<\/strong>\u00a0<strong><a href=\"https:\/\/fr.wikipedia.org\/wiki\/Convention_internationale\">international treaty<\/a><\/strong>\u00a0(adopted in 1989) that was signed by C\u00f4te d\u2019Ivoire in June 1994<br \/>This Convention was meant to reduce the flow of hazardous waste between countries.<\/p><p>For the purposes of the Basel Convention and the regulations in C\u00f4te d\u2019Ivoire, \u201cwaste\u201d means <strong>substances or objects that are disposed of, intended to be disposed of or are required to be disposed of<\/strong> under the provisions of national law (Art. 2, \u00a71).<br \/>The scope of the Convention and the definition of hazardous waste is specified in Article 1<br \/>The<em><a href=\"http:\/\/www.basel.int\/Portals\/4\/Basel%20Convention\/docs\/text\/BaselConventionText-f.pdf\"><strong> Convention text<\/strong><\/a><\/em>\u00a0is available at: http:\/\/www.basel.int\/Portals\/4\/Basel%20Convention\/docs\/text\/BaselConventionText-f.pdf<br \/>The Convention also aims to minimise the amount and toxicity of waste generated, and to assist developing countries to reasonably manage the waste they produce, whether harmful or not..<br \/>In response to the Convention, C\u00f4te d\u2019Ivoire has issued the following orders :<\/p><ul><li><em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/A2012.11ENVIR+cr%C3%A9ation+comit%C3%A9+national+des+dossiers+mouvements+transfronti%C3%A8res+d%C3%A9chets.pdf\/1c096b04-2b91-43b1-99e0-b2e6ef34c35a?version=1.0\">\u00a0Order N\u00b0 0011 MINSEDD\/DGE\/PFCB of 15 March 2012<\/a><\/em>\u00a0on the creation, attribution, organisation and functioning of the National Committee for the analysis of dossiers on transboundary movements of waste<\/li><li><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/A2012.12+Environnement+-+transfert+transfronti%C3%A8res+des+d%C3%A9chets.pdf\/ae93c31b-c78f-4c09-b1bc-7a08ce65a5b3?version=1.0\"><em>Order N\u00b00012 MINEDD\/DGE\/PFCB of 15 March 2012<\/em><\/a>\u00a0on the procedure for the authorisation of transboundary movements of wastes.<\/li><\/ul><p><strong><em><a href=\"http:\/\/www.environnement.gouv.ci\/fichier\/1432667898organigraminesudd.pdf\">\u00a0The General Directorate for the Environment and Sustainable Development of the Ministry of Health, the Environment and Sustainable Development <\/a><\/em><\/strong>\u00a0is the competent authority for the implementation of the Basel Convention in C\u00f4te d\u2019Ivoire.<br \/>Prior to any export transaction, the economic operator must complete the <a href=\"http:\/\/www.basel.int\/Portals\/4\/Basel%20Convention\/docs\/techmatters\/forms-notif-mov\/vCOP8_f.pdf\"><strong><em>Notification and Movement Documents for Transfrontier Waste Transfers<\/em><\/strong><\/a> and compile a file that will be examined by <strong>the National Committee for the Analysis of Transboundary Waste Movements<\/strong> in order to obtain <strong>an Export Authorisation.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element nature of the activity as subject.<\/li><li>The CNPS certificate (National Social Security Fund).<\/li><li>The Tax Certificate (Fiscal Declaration of Existence \u2013 DFE).<\/li><li>Photocopy and original of the National Identity Card or Identity Certificate or Passport of the person(s) responsible for the Company.<\/li><li>Photo ID of the person(s) in charge of the company.<\/li><li>Criminal record dated within three (3) months of the Company\u2019s manager(s).<\/li><li>The Geographical Location of the Company.<\/li><li>The Company\u2019s Certificate of Insurance.<\/li><\/ul><ul><li>The submitted to a <strong>National Committee for the Analysis of Transboundary Movement of Waste Dossiers which meets approximately four (4) times a year <\/strong>\u2013 See\u00a0<em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/A2012.11ENVIR+cr%C3%A9ation+comit%C3%A9+national+des+dossiers+mouvements+transfronti%C3%A8res+d%C3%A9chets.pdf\/8ed8efdf-661e-4bb2-a677-b2e031bd6d39?version=1.0\">Order N\u00b00011 MINSEDD\/DGE\/PFCB of 15 march 2012<\/a><\/em><em>.\u00a0<\/em>The National Committee is composed of the following structures\u00a0:<\/p><ul><li>Ministry of the Environment (DDISC, CIAPOL, Department of Legal Affairs and Litigation, Basel Convention Focal Point).<\/li><li>Ministry of Industry and Mines.<\/li><li>Directorate General of Maritime Affairs.<\/li><\/ul><p>Autonomous Port of Abidjan.<\/p><p>Autonomous Port of San Pedro.<\/p><ul><li>General Directorate of Customs<\/li><\/ul><p>\u00a0<\/p><p>The Economic Operator is informed by the office of the Directorate General for the Environment of the decision of the National Committee.<br \/>The Operator must then provide the Approval to the Importer for approval in the country of destination.<\/p><\/div>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"d17c79c\" data-element_type=\"widget\" data-widget_type=\"heading.default\"><h5>Export Certificate and Exchange Commitment: GUCE procedure<\/h5><p><strong>To be noted in advance<\/strong><br \/>Beyond a value exceeding ten (10) million CFA francs, exports to countries outside the WAEMU are subject to domiciliation with an approved intermediary \u2013 See.\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/UEMOA-Reglement-2010-09-relations-financieres-exterieures-Annexe.pdf\/9f6aa738-2190-4790-b1a9-20bab0074849?version=1.0\"><em>Art.13, WAEMU Regulation 09\/2010.CM<\/em><\/a>.<br \/>The Exporter is then required to establish an <strong>Exchange Commitment<\/strong> and an <strong>Export Certificate<\/strong>.<br \/>These documents are required to validate the <strong>Customs Export Declaration<\/strong>.<br \/>The <strong>Export Certificate <\/strong>\u2013 See.\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/44572\/ECO1-attestation+d%27exportation-zdTFZFGM.pdf\/7102e4fe-2588-4228-9b42-5aaddee13c00?version=1.0\"><em>Example AE<\/em>\u00a0<\/a>\u2013\u00a0and the <strong>Exchange Commitment<\/strong> \u2013 See.\u00a0<a via the <a href=\"http:\/\/guce.gouv.ci\/?lang=fr\">Transactional Site of the Single Window for Foreign Trade<\/a>\u00a0 <a href=\"https:\/\/guce.gouv.ci\/register\/procedure\"><strong><em>Access to the site<\/em><\/strong><\/a>\u00a0requires <strong>prior registration as an importer, exporter or freight forwarder<\/strong>.<br \/>The information to be provided is as follows::<\/p><ul><li>Exporter Code (or Occasional Exporter Code).<\/li><li>Name and address of the Declarant.<\/li><li>Information appearing on the invoice (name of the receiver, HS code of the goods, quantity, amount invoiced, etc.).<\/li><li>Name of the bank (in C\u00f4te d\u2019Ivoire) involved in the transaction.<\/li><li>The invoice.<\/li><\/ul><\/div>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content For the purposes of the Basel Convention and the regulations in C\u00f4te d\u2019Ivoire, \u201cwaste\u201d means substances or objects that are disposed of, intended to be disposed of or are required to be disposed of under the provisions of national law (Art. 2, \u00a71).The scope of the Convention and the definition of hazardous waste is specified in Article 1The Convention text\u00a0is available at: http:\/\/www.basel.int\/Portals\/4\/Basel%20Convention\/docs\/text\/BaselConventionText-f.pdfThe Convention also aims to minimise the amount and toxicity of waste generated, and to assist developing countries to reasonably manage the waste they produce, whether harmful or not..In response to the Convention, C\u00f4te d\u2019Ivoire has issued the following orders : \u00a0Order N\u00b0 0011 MINSEDD\/DGE\/PFCB of 15 March 2012\u00a0on the creation, attribution, organisation and functioning of the National Committee for the analysis of dossiers on transboundary movements of waste Order N\u00b00012 MINEDD\/DGE\/PFCB of 15 March 2012\u00a0on the procedure for the authorisation of transboundary movements of wastes. \u00a0The General Directorate for the Environment and Sustainable Development of the Ministry of Health, the Environment and Sustainable Development \u00a0is the competent authority for the implementation of the Basel Convention in C\u00f4te d\u2019Ivoire.Prior to any export transaction, the economic operator must complete the Notification and Movement Documents for Transfrontier Waste Transfers and compile a file that will be examined by the National Committee for the Analysis of Transboundary Waste Movements in order to obtain an Export Authorisation. AUTHORISATION PROCEDURE INSTITUTIONSINVOLVED AUTHORIZATION TO EXPORT Any natural or legal person wishing to import, export or transfer hazardous waste must first complete a Notification and Transboundary Movement of Waste document and then compile a file before applying for a Waste Transfer Authorisation addressed to the Minister of the Environment and Sustainable Development who will forward it to the National Committee for the Analysis of Transboundary Movements of Waste Files for approval.Examination of the file in C\u00f4te d\u2019Ivoire is free of charge. DOCUMENTATION TO COMPLETE The\u00a0notification documents and transboundary movements of wastets\u00a0can also be downloaded from the website\u00a0of Basel Convention \u00a0or are physically available in the offices of the Department of Industrial Waste and Chemical Substances (DDISC) at Riviera 3 not far from the Lyc\u00e9e Fran\u00e7ais.The DDISC also houses the focal point of the Basel Convention. A copy of the Commercial Register with the nature of the activity as subject. The CNPS certificate (National Social Security Fund). The Tax Certificate (Fiscal Declaration of Existence \u2013 DFE). Photocopy and original of the National Identity Card or Identity Certificate or Passport of the person(s) responsible for the Company. Photo ID of the person(s) in charge of the company. Criminal record dated within three (3) months of the Company\u2019s manager(s). The Geographical Location of the Company. The Company\u2019s Certificate of Insurance. The \u00a0Notification and Transboundary Movement of Waste Documents. Information on the waste to be exported or imported, including: Prior waste identification form. Safety measures during transport. Description of containment, storage and transfer processes. The Transport Route. The Financial Guarantee. The Contract linking the requesting company to the recipient of the waste (in the event of export) or the Company of origin of the waste (in the event of import). The file is to be submitted to the offices of the General Directorate of the Environment or to the Mail Service of the Ministry in charge of the Environment. Obtaining the Hazardous Waste Transfer Authorization The dossier is submitted to a National Committee for the Analysis of Transboundary Movement of Waste Dossiers which meets approximately four (4) times a year \u2013 See\u00a0Order N\u00b00011 MINSEDD\/DGE\/PFCB of 15 march 2012.\u00a0The National Committee is composed of the following structures\u00a0: Ministry of the Environment (DDISC, CIAPOL, Department of Legal Affairs and Litigation, Basel Convention Focal Point).
