{"id":7656,"date":"2025-04-16T01:11:02","date_gmt":"2025-04-15T23:11:02","guid":{"rendered":"http:\/\/localhost\/pwic.gouv.ci\/?p=7656"},"modified":"2025-04-19T06:34:30","modified_gmt":"2025-04-19T04:34:30","slug":"rubber","status":"publish","type":"post","link":"https:\/\/www.gucecotedivoire.ci\/pwic\/en\/rubber\/","title":{"rendered":"Rubber"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"7656\" class=\"elementor elementor-7656\">\n\t\t\t\t<div class=\"elementor-element elementor-element-54c3dd68 e-flex e-con-boxed wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-parent\" data-id=\"54c3dd68\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-ac437e0 elementor-drop-cap-yes elementor-drop-cap-view-default exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"ac437e0\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;drop_cap&quot;:&quot;yes&quot;}\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In C\u00f4te d\u2019Ivoire, <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/L2017.540.pdf\/e2cb14bc-fb88-4597-af43-9e578fce457a?version=1.0\"><em>Law N\u00b02017-540 of 03 August 2017<\/em><\/a>\u00a0sets the rules relating to the <strong>regulation, control and monitoring of the activities of the rubber and oil palm sectors<\/strong>.<br \/>\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/D2018.228.pdf\/4e873a50-a3f1-4005-8fda-bf571061d3d5?version=1.0\"><em>Decree N\u00b0228\u00a0of 28 February 2018<\/em><\/a>\u00a0name of the Body in charge of the regulation, control and monitoring of the activities of the <strong>Rubber and Oil Palm sectors, namely the Rubber-Oil Palm Council (CHPH for short<\/strong><strong>)<\/strong>.<br \/>The exercise of the profession of <strong>rubber products exporter<\/strong> is subject to obtaining an <strong>Approval<\/strong> issued by the Rubber-Oil Palm Council, under the supervision of the <strong>Ministry of Agriculture and Rural Development<\/strong>, in accordance at <em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/L2017.540.pdf\/e2cb14bc-fb88-4597-af43-9e578fce457a?version=1.0\">Article 11 of Law\u00a0N\u00b0540 of 03 August 2017<\/a><\/em>.<br \/><strong>The export of rubber products <\/strong>also gives rise to the payment, by the exporter, of<strong> duties and taxes due to the State \u2013\u00a0<\/strong>See. class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5>AUTHORIZATION TO EXPORT<\/h5><p><strong>The export of rubber products <\/strong>(machined rubber and cup bottoms (raw rubber)) is reserved for the operators listed below<strong>, provided that they hold an Approval as an Exporter in the process of being validity:<\/strong><\/p><ul><li>Any natural or legal person whose main activity is the production of rubber products.<\/li><li>Commercial companies under Ivorian law whose purpose is the exploitation of rubber.<\/li><li>Agro-industrial companies under Ivorian law whose purpose is to export rubber products.<\/li><li>Cooperative companies and their unions, federations or confederations operating in the rubber sectors.<\/li><\/ul><p><strong>Exporter Quality Approval <\/strong>is issued for a renewable period of<strong> five (5) years <\/strong>by the Rubber-Palmier Oil Council<strong> in charge of regulating, controlling and monitoring the activities of the rubber sectors.<\/strong>.<br \/><strong>However, exceptionally, <\/strong>and according to Interministerial Orders n\u00b0635 of November 30, 2018 [A2018.635] and [A2018.663] n\u00b0663 of December 27, 2018<strong> granting exceptional authorization for the export of rubber cup bottoms, any operator is granted an Exceptional Authorization to Export Hevea Cup Funds,<\/strong> until<strong> December 31, 2019.<\/strong><br \/>These operators must first obtain a <strong>Prior Export Authorization<\/strong> issued by the Rubber-Oil Palm Council<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div id=\"e-n-tab-content-130737592\" role=\"tabpanel\" aria-labelledby=\"e-n-tab-title-130737592\" data-tab-index=\"2\" style=\"--n-tabs-title-order: 2;\" class=\" elementor-element elementor-element-6e1463e e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"6e1463e\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-946fc63 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"946fc63\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5>EXPORT APPROVAL (FOR MACHINED RUBBER)<\/h5><p><strong>The Approval application<\/strong> must be submitted to <strong>APROMAC<\/strong>, which verifies and compiles the file and sends it to the <strong>Minister of Agriculture and Rural Development<\/strong>. This request must be accompanied by the following documents:<\/p><ul><li>Approval request for the export of natural rubber formulated by APROMAC.<\/li><li>Copy of contracts with suppliers and customers.<\/li><li>\u00a0Identification of the operator: geographical location (address, telephone, fax, email, etc.), presentation of the leaders.<\/li><li>\u00a0Description of the characteristics of the machining methods and of the type of rubber produced for which approval is sought (attach a certificate of analysis from an approved laboratory).<\/li><li>\u00a0List and description of machining equipment.<\/li><li>Number of employees and qualifications of factory and\/or plantation managers.<\/li><li>Amount of capital.<\/li><li>Investment Approval Decision (issued by CEPICI).<\/li><li>Order on Investment Approval (issued by the Ministry of Economy and Finance).<\/li><li>Copy of the Order of the Ministry of the Environment approving the environmental impact study for the establishment of the plant.\u00a0<\/li><\/ul><p>Approval cost: <strong>500,000 CFA francs<\/strong>.<\/p><p>Upon receipt of the file, the Ministry of Agriculture and Rural Development organizes a joint visit to the site with the Ministry in charge of Trade and the Ministry in charge of Industry and produces a <strong>Visit Report<\/strong>.<br \/>The Ministry of Agriculture is prepares a <strong>draft Rubber Plant Exporter Approval Order for signature by the Minister<\/strong>, to which it attaches the following documents:<\/p><ul><li>Report of the visit to the factory site carried out by the joint team composed of the Ministries in charge of Agriculture, in charge of Trade and in charge of Industry.<\/li><li>Report from the analytical laboratory on the treatment product.\u00a0<\/li><li>Copy of <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/D99.212.pdf\/1c35a72c-71a2-415f-af65-eb2643889b95?version=1.0\"><em>Decree N\u00b0 212 of 10 March1999<\/em><\/a>\u00a0\u00a0on the marketing of rubber.<\/li><li>Copy of Order No. 057 of June 08, 1999 [A99.057] setting the conditions for approval of natural rubber exporters.<\/li><li>Copy of the Investment Approval Decision issued by CEPICI.<\/li><li>Copy of the Order on Investment Approval issued by the MPMEF.<\/li><li>Copy of the Order approving the Environmental and Social impact study issued by the Ministry of the Environmentt.<\/li><\/ul><p>The <strong>deadline for issuing an Approval<\/strong>, from the submission of the file to the Ministry of Agriculture and Rural Development by APROMAC, is <strong>one (1) month maximum<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div id=\"e-n-tab-content-130737593\" role=\"tabpanel\" class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<h5>Prior Export Authorization (for rubber cup bottoms)<\/h5><p>The file can only be submitted by <strong>a legally constituted company. The following file must be submitted to the H\u00e9v\u00e9a-Palmier \u00e0 Huile Council at the CAISTAB Building, 4th floor, Door 11:<\/strong><\/p><ul><li>Complete the structure information form (structure information letter).<\/li><li>Letter of request.<\/li><li>Extract from the Trade and Personal Property Credit Register \u2013 To be presented only once, on the first request.<\/li><li>Declaration Fiscale d\u2019Existence (DFE) \u2013 To be presented only once, during the first application.<\/li><li>The Tax Regularity Certificate (ARF) valid and issued to the Tax Center of the district where the company is domiciled).<\/li><li>CNPS regularity certificate in progress.<\/li><li>For companies subject to online declaration (e-tax): the receipt or payment certificate issued by the General Tax Department.<\/li><\/ul><p>Cost of the application :\u00a0<strong>5, 000 FCFA \/ File<\/strong><br \/>Deadline for authorisation: authorisations are issued <strong>at the beginning of each month<\/strong><strong>s<\/strong>.<br \/>Period of Validity of the Authorisation: 2 months from the date of issue\u00a0<\/p><p><strong>To be noted<\/strong><\/p><ul><li>The <strong>global annual quota<\/strong> granted in 2019 by Article 5 of Order n\u00b0663 of 27 December 2018 [A2018-663] for the <strong>export of cup bottoms is 350,000 T,<\/strong> which is equivalent to a global quota <strong>of 35,000 T\/month<\/strong> over the 10 months of the rubber harvest.<\/li><li>The Prior Export Authorization and proof of payment issued by the Tax Department and by the Rubber-Oil Palm Council are admissibility documents <u>for export<\/u>.<\/li><\/ul>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"d17c79c\" data-element_type=\"widget\" data-widget_type=\"heading.default\"><h5>Export Certificate and Exchange Commitment<\/h5><p>When <strong>the value of the goods to be exported is greater than or equal to ten (10) million FCFA<\/strong>, an <strong>Export Certificate <\/strong>and an <strong>Exchange Commitment<\/strong> are necessary to have <strong>the Export Declaration validated by Customs<\/strong>.<strong> \u2013<\/strong>\u00a0<em>See\u00a0<\/em><em><u>Regulation 09\/1998\/CM\/ WAEMU<\/u><\/em>.<br \/>The<strong> Export Certificate<\/strong> \u2013\u00a0<em>See.\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/44572\/ECO1-attestation+d%27exportation-zdTFZFGM.pdf\/7102e4fe-2588-4228-9b42-5aaddee13c00?version=1.0\">Example AE<\/a>\u00a0<\/em>\u2013\u00a0and the <strong>Exchange Commitment<\/strong> \u2013\u00a0<em>See.\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/72899\/EC+ENG-CHANGE%28EX%29.pdf\/a83c75e0-aa64-4ce4-827a-ddcc7d885eed?version=1.1\">Example EC<\/a><\/em>\u00a0\u2013\u00a0are established <strong>online<\/strong>, via the transactional site of <em><a href=\"https:\/\/guce.gouv.ci\/?lang=fr\">\u00a0Foreign Trade Single Window (GUCE)<\/a><\/em>. <em><a href=\"https:\/\/guce.gouv.ci\/register\/procedure\"><strong>Access to the site<\/strong><\/a><\/em>\u00a0requires <strong>prior registration as an importer, exporter or freight forwarder<\/strong>. The information and documents to be provided are as follows::<\/p><ul><li>Professional Exporter Code (or Occasional Exporter Code).<\/li><li>Name and address of the Declarant.<\/li><li>Information appearing on the invoice (name of the receiver, HS code of the goods, quantity, amount invoiced, etc.).<\/li><li>Name of the bank (in C\u00f4te d\u2019Ivoire) involved in the transaction.<\/li><li>The bill.<\/li><\/ul><\/div>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<h5>Customs declaration<\/h5><p>List of documents to send to the freight forwarder to make <strong>the Export Declaration to Customs\u00a0<\/strong>:<\/p><ul><li>The Exporter Code.<\/li><li>\u00a0The Original Invoice.<\/li><li>The Export Certificate (if the value is greater than ten (10) million FCFA, via the GUCE) (may be carried out by the freight forwarder).<\/li><li>The Change Commitment, via the GUCE (perhaps carried out by the freight forwarder).<\/li><li>The Certificate of Origin (EUR1 or UEMOA\/ECOWAS or Form A).<\/li><li>Exporter Approval (for machined rubber) or Prior Export Authorization (for cup bottoms) for the year 2018.<\/li><\/ul><p>\u00a0Prior Export Certificate (Origin).<\/p>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"d17c79c\" data-element_type=\"widget\" data-widget_type=\"heading.default\"><h5>Quality Control and Packaging of Cup Bottoms<\/h5><p>The quality control and packaging of rubber cup bottoms intended for export by sea must meet the following conditions:<\/p><ul><li>Have a dry matter rate or Dry Rubber Content (DRC) greater than or equal to 65%.<\/li><li>Be free of any contaminants.<\/li><\/ul><p>Rubber cup bottoms intended for export by sea are subject to quality control by a company approved by the CHPH and responsible for issuing a <strong>Certificate of Conformity<\/strong>.
