Article 108 of\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2014.397+Decret_application+2014-397+du+code+miniermodalite+d%27application+de+la+loi+2014-138.pdf\/703527e6-5a40-4345-a639-0287804b42ae?version=1.0\">Decree N\u00b02014.397 of 25 June 2014<\/a><\/em>\u00a0and \u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/ARR%C3%8AT%C3%89+501+DELIVRANCE+DU+CERTIFICAT+DU+PROCESSUS+DE+KIMBERLEY+DANS+LE+CADRE+DE+L%27EXPORTATION+DES+DIAMANTS+BRUTS+2014.pdf.pdf.pdf\/61cd627e-2321-4c91-b587-967cb6766860?version=1.0\"><em>Order N\u02da2014.501\/MIM OF 10 November 2014<\/em><\/a>.<\/p><p>The competent authority responsible for issuing and signing Kimberley Process Certificates is <strong>the Permanent Secretariat of the Kimberley Process Representation in C\u00f4te d\u2019Ivoire (SPRPK-CI). trader<\/strong> in C\u00f4te d\u2019Ivoire is subject to <strong>prior authorisation<\/strong>.<br \/>The conditions <strong>for applying for this Authorization<\/strong> differ, depending on whether it is a <strong>Company<\/strong> or an <strong>Individual<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6ccf1d7 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-exad-exclusive-tabs\" data-id=\"6ccf1d7\" data-element_type=\"widget\" data-e-type=\"widget\" class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<h5>PROCEDURE FOR ESTABLISHING A PURCHASING, IMPORT AND EXPORT OFFICE IN THE CASE OF A COMPANY\/LEGAL PERSON<\/h5><p>Only <strong>State-approved Diamond Buying Offices<\/strong> are authorized <strong>to export Diamonds<\/strong> from C\u00f4te d\u2019Ivoire.<\/p><p>In accordance with <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2014.397+Decret_application+2014-397+du+code+miniermodalite+d%27application+de+la+loi+2014-138.pdf\/703527e6-5a40-4345-a639-0287804b42ae?version=1.0\"><em>Article 107 of Decree N\u02da2014-397 of 25 Juine2014<\/em><\/a>,\u00a0<strong>the Approval in the capacity of Office of purchase, Import and Export of rough Diamonds <\/strong>is granted by Order of the Minister in charge of Mines, for<strong> a duration of three (3) years <\/strong>renewable, to the<strong> Legal Entities without <\/strong>antecedent in the illicit trade and without link with suspicious networks and which commit themselves to<strong> respecting all the requirements <\/strong>of the Certification Scheme of the Kimberley Process to undertake this activity<\/p><p><strong>The establishment of a Purchasing Office<\/strong> is done through <strong>an application<\/strong> <strong>\u2013\u00a0<\/strong><em>See.\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/A2014.502+MIM+-+agr%C3%A9ments+bureaux+export+import+demandes+d%27autorisation+d%27exportation+diamants.pdf\/5095b1c8-01f6-4656-83df-f1e91ec4609e?version=1.0\">Order N\u00b0502\/MIM of 10 November 2014<\/a><\/em>.<br \/>The <strong>application file for the Granting or Renewal of the Approval of an Office for the Purchase, Sale, Import and Export of Rough Diamonds<\/strong> must, <strong>under penalty of inadmissibility<\/strong>, include the following elements:<\/p><ul><li>A Letter of Request addressed to the Minister in charge of Mines.<\/li><li>The Articles of Association of the company\u0301.<\/li><li>A Trade Register for the \u201cpurchase, sale, export and import of Diamonds.<\/li><li>A passport photo of the manager.<\/li><li>A Certificate of Nationality\u0301 of the Manager.<\/li><li>A criminal record dated within three (3) months of the Manager.<\/li><li>A Certificate of Residence from the Manager.<\/li><li>A certificate of tax regularity dated less than one (1) year ago.<\/li><li>A bank certificate showing a credit balance of at least ten (10) million CFA francs and dated within the last three (3) months.<\/li><li>A document identifying the financial institutions with which the resources will be domiciled.<\/li><li>The list of countries where the company is established, with copies of the approvals obtained.<\/li><li>The List of all affiliated companies.<\/li><li>The complete list of all Shareholders holding at least 10% of the shares, with their address and main activity.<\/li><li>Receipt of payment of the fixed fee provided for in the mining regulations:\u00a0<strong>The fixed fee for the Granting or Renewal of the Purchasing Office Approval <\/strong>is<strong> Thirty (30) million FCFA <\/strong>\u2013\u00a0<em>See.\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2014.632+droits+fixes+activit%C3%A9s+mini%C3%A8res+22_10_2014.pdf\/19741210-8987-4394-afc5-e1db61a7cfde\">Decree N\u00b02014.632\u00a0of 22 Octobrer 2014<\/a><\/em>. This fee is payable <strong>in three (3) equal instalments<\/strong> of ten (10) million francs each, the first of which is payable <strong>at the time of application<\/strong> and the other instalments <strong>no later than the anniversary date of the issuance of the Authorisation to the Purchasing Office (during the 2nd Year<\/strong><strong>).<\/strong><\/li><\/ul><p>The <strong>application file<\/strong> must be submitted to the General Directorate of Mines and Geology (Cit\u00e9 Administrative \u2013 Plateau, Tower E, Courier Service 15th floor) in <strong>four (4) physical copies<\/strong>, one of which must be marked \u201coriginal\u201d and the other three (3) \u201ccopy\u201d. These documents must be accompanied by <strong>a digital version on a USB key.<\/strong><\/p><p>The deadline for obtaining an Approval is <strong>90 days<\/strong>.<br \/>The Validity Period of an Approval is <strong>3 years<\/strong><strong>.<\/strong><\/p>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"d17c79c\" data-element_type=\"widget\" data-widget_type=\"heading.default\"><h5>AUTHORIZATION FOR THE PURCHASE AND SALE OF ROUGH DIAMONDS IN THE CASE OF AN INDIVIDUAL\/COLLECTOR<\/h5><p>In accordance with <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2014.397+Decret_application+2014-397+du+code+miniermodalite+d%27application+de+la+loi+2014-138.pdf\/703527e6-5a40-4345-a639-0287804b42ae?version=1.0\"><em>Article 106 of Decree N\u02da2014-397of 25 June 2014<\/em><\/a>, <strong>the Authorization to Purchase and Sell Rough Diamonds<\/strong> is granted by Order of the Minister in charge of Mines, for a period of <strong>one (1) year<\/strong>, to <strong>Individuals <\/strong>enjoying their civic rights, providing proof of financial capacity, with no history of illicit trade, no connection to suspicious networks and a commitment <strong>to comply with all requirements<\/strong> of the Kimberley Process Certification Scheme to engage in activity.<\/p><p><strong>The Authorization to Buy and Sell Rough<\/strong> Diamonds gives <strong>Individuals<\/strong> the right to hold, buy and sell this type of product throughout the national territory. <strong>On the other hand, it does not confer the right to export or import<\/strong><strong>.<\/strong><\/p><p>The <strong>application file<\/strong> is submitted to the General Directorate of Mines and Geology of the Ministry of Mines and Geology, under the conditions determined in <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/ARR%C3%8AT%C3%89+501+DELIVRANCE+DU+CERTIFICAT+DU+PROCESSUS+DE+KIMBERLEY+DANS+LE+CADRE+DE+L%27EXPORTATION+DES+DIAMANTS+BRUTS+2014.pdf.pdf.pdf\/61cd627e-2321-4c91-b587-967cb6766860?version=1.0\"><em>Article 4 of Order N\u00b0501\/MIM of 10 November2014<\/em><\/a>.<\/p><\/div>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\r\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div id=\"e-n-tab-content-130737592\" role=\"tabpanel\" aria-labelledby=\"e-n-tab-title-130737592\" data-tab-index=\"2\" style=\"--n-tabs-title-order: 2;\" class=\" elementor-element elementor-element-7158f4d e-con-full e-flex wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no wpr-column-slider-no wpr-equal-height-no e-con e-child\" data-id=\"7158f4d\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-bba6f7f exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"bba6f7f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5>EXPORT AUTHORIZATION<\/h5><p>Any <strong>Company (Legal Person) or Individual<\/strong> wishing to export goods from C\u00f4te d\u2019Ivoire must first have <strong>an Importer\/Exporter Code, Occasional or not<\/strong> \u2013 see General Export Procedures tab.<\/p><p>In addition, as explained above, <strong>the export of Diamonds<\/strong> from C\u00f4te d\u2019Ivoire is subject to <strong>Prior Authorisation<\/strong> in accordance with the provisions of <em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D93.313+conditions+d%27importation+et+d%27exportation+%28version+consolide%CC%81e+14+fe%CC%81v.+2018%29.pdf\/7ca6e365-fe39-4451-8660-04ff872fd9a9\">Annex E of Decree 93.313<\/a><\/em>, issued by <strong>the Ministry of Mines and Geology.<\/strong><\/p><p><strong>The Authorization Form<\/strong> [See. diamonds established under the United Nations.<br \/>Rough Diamonds may only be exported in a <strong>tamper-proof, sealed container<\/strong> with the Kimberley Process Certificate attached.<\/p><p>To obtain a Kimberley Process Certificate, <strong>any Buyer\u2019s Office exporting rough diamonds<\/strong> must apply for an <strong>Assessment and Certification to the Permanent Secretariat<\/strong> of the Kimberley Process Representation in C\u00f4te d\u2019Ivoire (SPRPK-CI).<br \/>In accordance with <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/ARR%C3%8AT%C3%89+501+DELIVRANCE+DU+CERTIFICAT+DU+PROCESSUS+DE+KIMBERLEY+DANS+LE+CADRE+DE+L%27EXPORTATION+DES+DIAMANTS+BRUTS+2014.pdf.pdf.pdf\/61cd627e-2321-4c91-b587-967cb6766860?version=1.0\">Order\u00a0 N\u00b0501\/MIM of 10 November 2014<\/a>, determining how the Kimberley Process Certificate is to be issued for the export of rough diamonds, <strong>the application must include the following:<\/strong><\/p><ul><li>An Application Form for Assessment and Certification (to be obtained from the SPRPK-CI) ;<\/li><li>A Declaration on honour of the origin of the Rough Diamonds.<\/li><li>The Inventory of Rough Diamonds to be exported, specifying the number of stones and the number of carats.<\/li><li>A Stub of purchase receipts corresponding to the Rough Diamonds to be exported.<\/li><li>Receipt of payment of the fixed fee for the Kimberley Certificate provided for by the mining regulations, i.e. one hundred thousand (100,000) FCFA \u2013\u00a0 Report<\/strong> and <strong>Kimberley Process Certificate<\/strong> on the day of the assessment. \u2028<br \/>The <strong>Assessment Report<\/strong> is prepared by expert evaluators duly mandated
