procedures for the export of Coffee and Cocoa, two (2) of C\u00f4te d\u2019Ivoire\u2019s main export products<\/strong>, are governed by <strong>specific provisions<\/strong>.<\/p>\n<p>These include the following regulations\u00a0:<\/p>\n<ul>\n<li>Ordinance O2018.437 [O2018.756] to amend <em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/O2011.481+fixant+les+r%C3%A8gles+de+commercialisation+du+caf%C3%A9+cacao.pdf\/89eb2848-818f-4ce4-a11b-35925850e834?version=1.0\">Ordinance n\u00b02011.481 of 28 December 2011<\/a><\/em>\u00a0settng <strong>rules for the marketing and regulation of the coffee and cocoa sector<\/strong><strong>.<\/strong><\/li>\n<li><em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1008+fixant+les+modalit%C3%A9s+de+commercialisation+caf%C3%A9+cacao.pdf\/2e0efa74-debe-4b60-bffd-a630f11dabc3\">Decree N\u00b02012.1008 of 17 October 2012<\/a><\/em>\u00a0setting <strong>the terms and conditions for the Marketing of Coffee-Cocoa<\/strong>.<\/li>\n<li><em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1010+r%C3%A9glementant+la+profession+d%27exportateur+de+caf%C3%A9+cacao.pdf\/6e90d69b-cb11-4cb1-b421-964d9b1343f0\">Decree N\u00b02012.1010 of 17 October 2012<\/a><\/em>\u00a0regulating <strong>the<\/strong> <strong>Profession of Coffee Exporter \u2013 Cocoa<\/strong><strong>.<\/strong><\/li>\n<li><em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1011+r%C3%A9glementant+le+conditionnement+du+cacao.pdf\/689419da-0337-40f1-ad60-a6709d4daf95\">Decree N\u00b02012.1011 of 17 October 2012<\/a><\/em>\u00a0regulating <strong>the Packaging of Cocoa for Export<\/strong><strong>.<\/strong><\/li>\n<li><em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1012+r%C3%A9glementant+le+conditionnement+du+caf%C3%A9+vert.pdf\/ef1ba6e8-6b11-4a4c-addd-d6cc43259024\">Decree N\u00b02012.1012 of 17 Octobrer 2012<\/a><\/em>\u00a0regulating <strong>the packaging of green coffees for export<\/strong><strong>.<\/strong><\/li>\n<li><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/C2016.1769+MAPM+proc%C3%A9dures+douane+caf%C3%A9+cacao.pdf\/64c54fb1-1a4e-44a4-b935-b9fed7906d6f?version=1.0\"><em>Circular N\u00b01769\u00a0\/MPMBPE\/DGD\/ of 17 March 2016<\/em><\/a>\u00a0on <strong>Customs Procedures for Coffee \u2013 Cocoa<\/strong><strong>.<\/strong><\/li>\n<li><em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/54413\/D2013.221+relatif+%C3%A0+l%27exportation+du+cacao+hors+normes.pdf\/7c374adc-ad96-492c-9e3a-ef3ea05e3c4e?version=1.0\">Decree N\u00b02013-221 of 22\u00a0March 2013<\/a><\/em>\u00a0on <strong>the Export of non-standard cocoa, cocoa waste and residues<\/strong>.<\/li>\n<li>Interministerial Order No. 655 of December 24, 2018 [A2018.655] setting <strong>the Level of Taxes and Royalties for the 2018 \u2013 2019 cocoa campaign<\/strong><\/li>\n<\/ul>\n<p>Under the terms <em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/O2011.481+fixant+les+r%C3%A8gles+de+commercialisation+du+caf%C3%A9+cacao.pdf\/89eb2848-818f-4ce4-a11b-35925850e834?version=1.0\">Ordinance N\u00b02011.481 of 28 December 2011<\/a><\/em>,\u00a0<strong>the export of coffee and cocoa beans, semi-finished coffee and cocoa products and their by-products is reserved for companies under Ivorian law and professional agricultural organisations \u2013\u00a0<\/strong><em>See.\u00a0\u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1010+r%C3%A9glementant+la+profession+d%27exportateur+de+caf%C3%A9+cacao.pdf\/6e90d69b-cb11-4cb1-b421-964d9b1343f0\">Decree N\u00b02012.1010\u00a0of 17 October 2012<\/a>\u00a0\u2013<\/em>\u00a0for the <strong>purpose of exporting coffee and cocoa<\/strong>, and <strong>to producers of these products in C\u00f4te d\u2019Ivoire<\/strong>\u00a0\u2013\u00a0<em>See Art. 6 <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/O2011.481+fixant+les+r%C3%A8gles+de+commercialisation+du+caf%C3%A9+cacao.pdf\/89eb2848-818f-4ce4-a11b-35925850e834?version=1.0\">Ordinance N\u00b02011.481 of 28 December 2011<\/a><\/em>.<\/p>\n<p>In order to export, these operators <strong>must hold a valid Approval issued<\/strong> by the <strong>\u201cCouncil for Regulation, Stabilization and Development of the Coffee-Cocoa Sector\u201d<\/strong>, abbreviated as the <strong>\u201cCouncil of Coffee-Cocoa\u201d<\/strong> \u2013\u00a0<em>See. Decree n\u00b02013-221 of 22 March 2013 relating to the export of non-standard cocoa, cocoa waste and residues) is subject to obtaining an Approval issued by the Coffee \u2013 Cocoa Council \u2013 See. Decree n\u00b02012.1010 of 17 October 2012 This Approval must be renewed each year \u2013 Example List of approved exporters for the 2017\/2018 Campaign. Common Methods for the Packaging of Coffee and Cocoa for Export<\/h5>\n<p>With regard to <strong>the packaging of coffee and cocoa for export<\/strong>, <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/C2012.1561+MEF+qualit%C3%A9+emballages+caf%C3%A9+cacao.pdf\/1bcd6b6d-e44d-4b20-9c4a-e7eabf6e8b39?version=1.0\"><em>Circular n\u00b01561\/DGD\/DU of 29 October 2012<\/em><\/a>\u00a0specifies that the bags containing them must have previously obtained from their importer a <strong>Certificate of Conformity<\/strong> issued by the Customs Service, which is necessary for the issue of the <strong>Good to Remove<\/strong>.<\/p>\n<p>This certificate is issued upon presentation of the following documents :<\/p>\n<ul>\n<li>The certificate of their compliance with the Ivorian standard issued by CODINORM,<\/li>\n<li>A Certificate of Origin.<\/li>\n<li>A Document attesting to the recognition of the manufacturer by an association of the chocolate, biscuit and<\/li>\n<li>The reference of the balls<\/li>\n<\/ul>\n<h5>2. Cocoa Export Packaging Methods<\/h5>\n<p><strong>The rules for export packaging of cocoa are defined in the <em><a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1011+r%C3%A9glementant+le+conditionnement+du+cacao.pdf\/689419da-0337-40f1-ad60-a6709d4daf95\">Decree N\u00b02012.1011\u00a0of 17 October 2012<\/a>.<\/em><\/strong><br \/><strong>To be eligible for export, C\u00f4te d\u2019Ivoire origin cocoa must \u2013\u00a0<em>Art. 3o f \u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1011+r%C3%A9glementant+le+conditionnement+du+cacao.pdf\/689419da-0337-40f1-ad60-a6709d4daf95\">Decree N\u00b02012.1011 of 17 October 2012<\/a><\/em>\u00a0:<\/strong><\/p>\n<ul>\n<li>Be properly fermented.<\/li>\n<li>Have a maximum moisture content of 8%.<\/li>\n<li>Be clean and free of loose or adhering foreign matter (debris, mineral parts).<\/li>\n<li>Be free of extraneous odours, including mould, smoke and pesticides.<\/li>\n<\/ul>\n<p><strong>Cocoa grading is based on the percentage by number of defective beans, determined on a sample.<\/strong><br \/>Cocoa is classified into <strong>three (3) commercial types<\/strong>, i.e. from the best to the worst quality, classified as <strong>grade I, grade II and sub-grade<\/strong> respectively.<br \/><strong>Grade I or II cocoa<\/strong> is exported under the trade name \u00ab\u00a0<strong>Good Fermented (GF)<\/strong>\u00a0\u00bb.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e4d1f68 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-exad-exclusive-tabs\" data-id=\"e4d1f68\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"exad-exclusive-tabs.default\">\n\t\t\t\t<div I\t\t\t\t\t\t<\/span>\r\n\t\t\t\t\t<\/li>\r\n\t\t\t\t\t\t\t\t\t<li class=\" \" data-tab>\r\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"exad-tab-title\">\r\n\t\t\t\t\t\tCocoa grade II\t\t\t\t\t\t<\/span>\r\n\t\t\t\t\t<\/li>\r\n\t\t\t\t\t\t\t\t\t<li class=\" \" data-tab>\r\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"exad-tab-title\">\r\n\t\t\t\t\t\tSub-Grade Cocoa\t\t\t\t\t\t<\/span>\r\n\t\t\t\t\t<\/li>\r\n\t\t\t\t\t\t\t<\/ul>\r\n\t\t\t\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no active exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<p><strong>Grade I cocoa<\/strong> is composed of <strong>batches of beans<\/strong> that are uniform in colour and size and no <strong>more than 10%<\/strong> of the beans may <strong>vary in weight by more than 1\/3 \u00b1 the average weight of the beans<\/strong>.<br \/>In addition, <strong>the batch must not contain more than<\/strong>:<\/p>\n<ul>\n<li><strong>3% <\/strong>in number of<strong> mouldy beans.<\/strong><\/li>\n<li><strong>3% <\/strong>in the number of<strong> \u2018slate\u2019 beans.<\/strong><\/li>\n<li><strong>3% <\/strong>in the number of beans with<strong> other defects.<\/strong><\/li>\n<\/ul>\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content exad-tab-image-has-no  exad-tab-image-right\">\r\n\t\t\t\t\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-element\">\r\n\t\t\t\t\t\t\t<div class=\"exad-advance-tab-content-description\">\r\n\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-d17c79c exad-sticky-section-no exad-glass-effect-no elementor-widget (5) categories<\/strong> whose criteria are set by the <strong>Coffee and Cocoa Council, namely excellence, extra-prima, prima, superior and current criteria<\/strong>.<\/p>\n<p><strong>Coffee is exported in homogeneous lots comprising only coffee of a specific category and grade<\/strong>\u00a0\u2013\u00a0<em>Cf. Art. 11 of \u00a0<a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1012+r%C3%A9glementant+le+conditionnement+du+caf%C3%A9+vert.pdf\/ef1ba6e8-6b11-4a4c-addd-d6cc43259024\">Decree N\u00b02012.1012\u00a0of 17 October 2012<\/a><\/em>.<\/p>\n<p>The <strong>modalities for exporting in bags or in bulk and for marking the lots<\/strong> are set by the Coffee and Cocoa Council.<\/p>\n<p><strong>Coffee for export<\/strong> is subject <strong>to Quality Control.<\/strong><br \/><strong>The concessionary bodies for control activities<\/strong> are responsible for <strong>the certified quality of the product on board<\/strong> under the conditions defined in the specifications annexed to the concession agreement that they conclude with the State.<br \/>These bodies issue <strong>an Export Quality Control Certificate.<\/strong><\/p>\n<p>This <strong>Certificate is valid for thirty (30) days from the date of verification<\/strong>, provided that no subsequent alteration reduces the quality of the product. After this period, the non-exported lots must be re-inspected and, if necessary, reclassified..<br \/>The <strong>list of bodies authorised to control the quality of coffee batches for export<\/strong> is available on the\u00a0<em><a href=\"http:\/\/www.conseilcafecacao.ci\/index.php?option=com_content&amp;view=article&amp;id=79&amp;Itemid=148\">Coffee and cocoa council website<\/a><\/em>\u00a0\u2013<br \/><em><a href=\"http:\/\/www.conseilcafecacao.ci\/index.php?option=com_content&amp;view=article&amp;id=79&amp;Itemid=148\">http:\/\/www.conseilcafecacao.ci\/index.php?option=com_content&amp;view=article&amp;id=79&amp;Itemid=148<\/a><\/em>.<\/p>\n<p><strong>After quality control, <\/strong>products intended for export must undergo a<strong> Phytosanitary Treatment before shipment<\/strong>.<\/p>\n<p><strong>Phytosanitary treatments<\/strong> are carried out by operators approved by the Ministry of Agriculture and Rural Development \u2013<em><u>Example of the 2017\/2018 Campaign\u2019s approved applicator list <\/u><\/em><\/p>\n<p>The <strong>procedures for obtaining an Approval<\/strong> are described on the Public Service website namely\u00a0:\u00a0<em>http:\/\/servicepublic.gouv.ci\/accueil\/demarcheparticulier\/2\/100\/13<\/em>.<\/p>\n<p><strong>The period of validity of the Phytosanitary Treatment Certificate is<\/strong> set at <strong>twenty-one (21) days from the day of treatment<\/strong>. After this period, the non-exported batches must be <strong>reprocessed<\/strong>.<\/p>\n<p>During this period, the Administration in charge of its inspection issues, free of charge, at the exporter\u2019s request, an <strong>Authorisation to Quay <\/strong>and then, <strong>after shipment, a Phytosanitary Certificate.<\/strong>The <strong>cost of issuing the phytosanitary certificate<\/strong> is <strong>CFAF 0.3 per kilo of coffee exported<\/strong> <strong>\u2013<\/strong>\u00a0(See. In this case, an invoice marked<strong> \u201cseen as shipped\u201d <\/strong>is sent to the Council (Art. 9 of the Ordinance).<\/li>\n<\/ul>\n<p>Export operations are carried out by <strong>commercial period<\/strong>, determined by the Council. They are subject to the prior granting of an <strong>Export Right<\/strong>, covering a given quantity, quality, price and deadline \u2013\u00a0<em>See. Art. 11\u00a0of <a href=\"https:\/\/pwic.gouv.ci\/documents\/11439\/30935\/D2012.1008+fixant+les+modalit%C3%A9s+de+commercialisation+caf%C3%A9+cacao.pdf\/2e0efa74-debe-4b60-bffd-a630f11dabc3\">Decree N\u00b02012.1008 of 17 October 2012<\/a>\u00a0\u2013<\/em>\u00a0mentioning:<\/p>\n<ul>\n<li>The Identity of the Operator.<\/li>\n<li>The Exporter Code\/Customer Code.<\/li>\n<li>Countryside.<\/li>\n<li>The Harvest.<\/li>\n<li>The Nature of the product (Coffee or Cocoa).<\/li>\n<li>The amount.<\/li>\n<li>Quality (reference grade).<\/li>\n<li>The Boarding Period and its deadline.<\/li>\n<li>The Reference Destination of the product.<\/li>\n<li>The Sale Price in CFA and in foreign currencies.<\/li>\n<\/ul>\n<p>Any sale shall give rise to the issue of a contractual document called <strong>\u201cConfirmation of Sale<\/strong> [See. Example CV]\u201d, accompanied by a guarantee in the form of a <strong>bank guarantee<\/strong> deposited within <strong>four (4) working days<\/strong> with the Cocoa Coffee Council, the amount of which shall be fixed by the Council, as well as a <strong>cover contract<\/strong>.<br \/>This <strong>\u201cSales Confirmation (SC)\u201d<\/strong> then allows the exporter to initiate <strong>shipment procedures<\/strong> \u2013\u00a0<em>See. Art. 11 du\u00a0<\/em><em><a href=\"http:\/\/uatpwic.guce.gouv.ci\/documents\/11439\/30935\/D2012.1012+r\u00e9glementant+le+conditionnement+du+caf\u00e9+vert.pdf\/ef1ba6e8-6b11-4a4c-addd-d6cc43259024\">D\u00e9cret n\u00b02012.1012\u00a0du 17 Octobre 2012<\/a><\/em>.<\/p><p>Les <strong>modalit\u00e9s d\u2019exportation en sacs ou en vrac et de marquage des lots<\/strong> sont fix\u00e9s par le Conseil Caf\u00e9 \u2013 Cacao.<\/p><p>Le <strong>Caf\u00e9 destin\u00e9 \u00e0 l\u2019exportation<\/strong> est soumis au <strong>Contr\u00f4le de Qualit\u00e9<\/strong>.<br \/>Les <strong>organismes concessionnaires des activit\u00e9s de contr\u00f4le<\/strong> sont responsables de <strong>la qualit\u00e9 attest\u00e9e du produit \u00e0 l\u2019embarquement<\/strong> dans les conditions d\u00e9finies par le cahier des charges annex\u00e9 \u00e0 la convention de concession qu\u2019ils concluent avec l\u2019\u00c9tat.<br \/>Ces organismes d\u00e9livrent un <strong>Certificat sanctionnant le Contr\u00f4le de Qualit\u00e9 \u00e0 l\u2019exportation<\/strong>.<\/p><p>Ce <strong>Certificat est valide Trente (30) jours \u00e0 compter du jour de la v\u00e9rification<\/strong>, sous r\u00e9serve qu\u2019aucune alt\u00e9ration ult\u00e9rieure ne vienne d\u00e9pr\u00e9cier la qualit\u00e9 du produit. In order to export, these operators must hold a valid Approval issued by the \u201cCouncil for Regulation, Stabilization and Development of the Coffee-Cocoa Sector\u201d, abbreviated as the \u201cCouncil of Coffee-Cocoa\u201d \u2013\u00a0See. Art. 7 of\u00a0Ordinance N\u00b02011.481 of 28 December 2011\u00a0\u2013\u00a0in charge of regulating the Coffee \u2013 Cocoa sector, stabilizing Coffee \u2013 Cocoa prices, which is the public body placed under the technical supervision of the Ministry of Agriculture and Rural Development . The conditions required to be able to apply for a Coffee \u2013 Cocoa Exporter Approval, as well as the formalities to be completed to obtain it, are detailed in Decree N\u00b02012.1010\u00a0of 17 October 2012\u00a0regulating the Profession of Coffee Exporter \u2013 Cocoa. \u00a0 Coffee and Cocoa Council (CCC) The Council for the Regulation, Stabilization and Development of the Coffee-Cocoa Sector, abbreviated as the Coffee and Cocoa Council (CCC)\u00bb \u2013 See.\u00a0Ordinance N\u00b02011.481 of 28 Decembre 2011 and \u00a0[D2012.06] is a sui-generis public body which is the sole management body of the Coffee \u2013 Cocoa sector in C\u00f4te d\u2019Ivoire. The State has entrusted the Coffee-Cocoa Council with the mission of regulating and developing the activities of the sector, as well as that of stabilizing the prices of these raw materials [O2018.756]. Common Methods for the Packaging of Coffee and Cocoa for Export With regard to the packaging of coffee and cocoa for export, Circular n\u00b01561\/DGD\/DU of 29 October 2012\u00a0specifies that the bags containing them must have previously obtained from their importer a Certificate of Conformity issued by the Customs Service, which is necessary for the issue of the Good to Remove.
